Fistgate: Body Cavity Searches Leading to Many Lawsuits

BODY CAVITY SEARCH LEADING TO MANY LAWSUITS

Laws are now in place to give rectal searches across the borders. Florida appellate court ruled that rectal searches are legal. According to the Fifth District Court of Appeals, the removal of 54 grams of cocaine from a suspect’s rectum by a member of the Orange County Highway Drug Squad “was part of a legal pat-down to make sure the suspect wasn’t armed”. The City of Baltimore has a 210 million dollar lawsuit pending regarding a rectal search of one of its local businessman. My next door neighbor, whose name I will not disclose (though it will be made public soon), is a disabled man whom the Montgomery County, Maryland Police brutalized by beating him up, taking his crutches away from him and making him hop on one leg over a long distance. No assistance was given after falling like Jesus on his Via Della Rosa. Subsequently, he was stopped and rectally searched while this suit is pending.

But wait, Obama’s appointment of Kevin Jennings, Director of the Office of Safe and Drug Free Schools, and founder of GLSEN, Gay and Lesbian and Straight Education, advocates promoting workshops in which fisting was done to fourteen year olds. It appears that the government literally wants to explore everyone's ass in the name of homeland security and education. Every political scandal has a name; we’ll have to call this Fistgate.
• According to a recent Amnesty International study, there are thousands of reports each year of assault and ill treatment against officers who use excessive force and violate the human rights of their victims (AIUSA Rights 1999:1). Police officers are injuring and even killing people through the use of excessive force and brutal treatment. Is this a violation of the fourth, fifth, eighth and fourteen amendment of the U.S. Constitution? Apparently a Middleton, Connecticut Citizen thinks so. Alexander Cotto, a non-English speaking citizen, was said to be driving his motor vehicle on Main Street at approximately 10 p.m. on Jan. 12, 2010, when he was pulled over by Officer Lukanik and another unidentified officer.
Lukanik allegedly approached the motor vehicle and asked Cotto for identification, which Cotto did not present. Lukanik continued to ask further questions of the man to which Cotto responded, “me no English,” according to the report issued by Cotto. According to the report, Lukanik responded in a “mocking manner” and said, “No English? ... You know English,” and subsequently forced Cotto out of the car and placed him in handcuffs. The report states that a drug sniffing canine was then used to perform a search in and around Cotto’s vehicle. No illegal substances were found. Lukanik then placed the dog back into his cruiser. Turning to Cotto, Lukanik ordered him to place his hands atop the car and spread his legs. The officer then allegedly pulled down the man’s pants and undergarments, exposing his genitalia publicly.

Without Cotto’s consent, Lukanik proceeded to perform a full cavity search by placing two of his fingers up Cotto’s rectum, states the report. Cotto said he did not wear protective gloves. After a first attempt, the officer did not find anything and, according to the report, inserted his fingers into Cotto’s rectum a second time.
Maybe since torture was sanctioned by Bush and Cheney every other kind of violation will be tolerated.
