¡Apoyo a la HUELGA de los INMIGRANTES!

Derecho completo para todos los inmigrantes, ahora!

Millones de inmigrantes estan tomando las calles en protesta ante la viciosa legislación del Congreso, que ha estado manipulando en su contra. Proyectos de ley que podría transformar de la noche a la mañana de 10 a 12 millones de inmigrantes en este pais, en criminales, proyectos de ley que bloquearía el status de 12 millones por 12 o 13 años antes de que pudieran obtener su ciudadanía, proyectos de ley con la creación de un programa de “trabajador eventual” que super-explotaría millón y medio de Mexicanos, Caribeños y otros trabajadores de la agricultura. Proyectos de ley para inmigrantes que estarían sujetos mas alla de un regimen policial. Además a estos proyectos de ley, la gran erupción de protestas conectadas que se ha venido estado construyendo por años de discriminación racial y opresión en contra de inmigrantes no blancos.

Es un hecho que capitalitas quieran conducir una crusada de congreso reaccionario sin derechos para el trabajor inmigrante para poder explotarlos mas lucrativamente. Implantando leyes que mantendrían millones de trabajadores inmigrantes bajo el miedo la deportación si estos protestan, o por otro lado el defender sus derechos que sirvieran para la propuesta, se les serían negados a los “trabajadores eventuales” los mismos derechos que otros trabajadores. De esta manera, las ganancias de los capitalistas se veran maximizados y las conditiones de vida y trabajo para la clase trabajadora se verían disminuidas.

Para que la clase trabajadora ponga en efecto esta resistencia, debe demandar derecho completo para hermanos inmigrantes, quienes tengan o no tengan sus papeles en orden. Pero, así como el congreso debate sobre estas nuevas leyes antimigratorias, la demanda de derechos completos para los inmigrantes es una que debe ser leventada en las calles como una parte general o esencial en la lucha entre trabajadores y capitalistas.

Los trabajadores - nacionales, naturalizados o nuevos inmigrantes- no tienen amigos en el Congreso

El proyecto de ley de Sensenbrenner H.R. 4437, y el fallido compromiso del Senado, han sido construidas al rededor del proyecto de ley de McCain-Kennedy, propuestas que son todas ataques viciosos contra inmigrantes y trabajadores.

La propuesta H.R. 44337, la cual fue pasada a la Casa de Representativos en Diciembre, es la proyecto de ley que convertira a un estimado de 10-12 millones de inmigrantes “ilegales”, actualmente trabajando, pagando cuentas, y comprando en tiendas, etc., etc., en criminales en Estados Unidos. Así, del mismo modo, haciendo cargos criminales para los ciudadanos que traten de ayudarlos. Tambien, se construiran mas de 700 millas de pared a lo largo del borde de Mexico con Estados Unidos, contratando mas policía migratoria y una larga lista de otras medidas con policías estatales.

Esta es el proyecto de ley que ha movilizado a millones de personas en este pais, dentro de una mocíon política durante los pasados meses. Desde pequeños poblados a grandes ciudades, gente ha salido a protestar a las calles, siendo algunas de estas demostraciones las mas largas nunca antes tenidas en una particular area o ciudad. En Chicago, por ejemplo, mas de 100,000 personas llenaron las calles el 15 de Marzo del 2006. Los Angeles un estimado de 500,000 a un millón de personas concurieron las calles el 25 de Marzo y en el 9 de Abril , 350,000 a 500,000 personas marcharon en las calles de Detroit. También, han habido manifestaciones de estudiantes, trabajadores y otros protestantes centralizadas en comunidades mexicanas.

Estos eventos han sido bienvenidos y dejan respiro de aire fresco en medio de la putrefacta neblina de la apestosa ala derecha que ha estada emanando por décadas de Washington. Pero el dominante liderazgo de los grandes protestas, las corrientes de los grupos de derechos del inmigrante, los lideres de la clase del SEIU, y UNITE-HERE uniones, han estado solo trabajando y concentrándose en odiar a la muy abierta antimigrante propuesta H.R.4377, que sería, sin duda alguna, soporte del proyecto de ley McCain-Kennedy, y posteriormente de la propuesta comprometida del Senado. Esto sería una traición a las masas porque estas propuestas de ley son también podridas propuestas antimigratorias.

El proyecto de ley de McCain-Kennedy doblaría el número de agentes que patrullan el borde, e incrementaría la coordinación entre los diferentes departamentos de policía. La ley gastaría billones de dolares en la instalación de equipo de alta tecnología en sistema de vigilancia a lo largo del borde Mexico-US (una pared “virtual” en lugar de la pared real de Sensenbrenner) . Por supuesto, el gobierno de los Estados Unidos empezó construyendo cercas, y aumentando sus medidas a lo largo del borde, durante el govierno de Clinton en el 94’. Pero, estas medidas no han evitado que la gente siga cruzando el borde hacia los Estados Unidos ilegalmente, estas cercas solo han ocasionado que las personas encuentren otros caminos mas alejados en el Desierto y las Montañas para cruzar. El 6 de Abril, el periódico de Seattle Post-Intelligencer cita coyotes que afirman gustarles estas nuevas medidas porque se les ha permitido cuadruplicar el “precio” en 10 años. Además, de esta manera ellos ven mas ganancias con menos esfuerzo. (Las funerarias también han tenido mas trabajo - 460 hombres, mujeres y niños murieron intentando cruzar, solo el año pasado.)

Pero esto es solo el comienzo, el proyecto de ley de McCain Kennedy implantaría un sistema de verificación electrónica que forzaría a los inmigrantes cargar con una identificación difícil de falsificar, conectada a una gran base de datos nationales conteniendo la historia del trabajador inmigrante, su estatus legal, huellas digitales, y la examinación del iris del ojo. Mas allá de esto, la propuesta llavaría eventualmente a la extensión de dicha verificación electrónica a todo trabajdor. Es este, el marco para el establecimiento de un sistema national de identificación fascista, en donde empleadores y el gobierno utilizarían para localizar a todo trabajador, espiarían organizaciones de trabajadores y otros activistas y quitar a los que no les gustan.

¿Asi que, despues de todo esto, como es que los lideres de estas grandes protestas, uniones oficiales, grupos “oficiales” para los derechos del imigrante, etc, han sido capaces de escaparse con el soporte de esta propuesta reaccionaria? Bueno, ellos han expresado que una reforma “comprensible” era necesaria, e ignorando los ataques que la propuesta McCain Kennedy contiene, manifestaron que se daría estatus legal a trabajadores indocumentados. ¡Pero, ellos han estado escondiendo hechos tales como el que el inmigrante deberá esperar al menos 10 años antes de que el o ella pudiera convertirse enciudadano (y en donde no todos los inmigrnates indocumentados podrían no ser cubiertos) y 6 años para obtener una “green card”! Esto significa el gasto de miles de dolares en pagos y cuotas, acreditar examenes, no estar desempleado por mas de 6 meses, etc. Por lo tanto, por más de una década estos inmigrantes obtendrían un status de segunda clase, que sería vigilada de cerca por el gobierno. Los inmigrantes tendrían a la deportación colgando sobre sus cabezas, si uno de ellos alza la voz en protesta en contra de estas condiciones. Además, los costos y los obstáculos de estas propuestas estarían tan altas que sería imposible para algunos inmigrantes cubrirla, mientras otros que no quieran seguir adelante con los trámites por miedo a estos años de obstáculos y terminen fallando en el proceso, y al final estos inmigrantes sean deportados.

La propuesta comprometida del Senado es aun peor. Esta redujo el numero temporal de inmigrantes legales , del numero propuesto por la propuesta McCain-Kennedy, de 400,000 a 75,000 por año. (y Yahoo’s “Daily News” reportó que hoy día podría tomarse mas de 13 a 14 años para un inmigrante indocumentado en obtener la ciudadanía) . Está, también, estableció un programa para 1.5 millones de trabajadores temporales de la industria de la agricultura hasta 5 años (mas parecido a un trabajo de esclavo). También, permitió mas deportaciones de no ciudadanos sin audiencia, y extendió el poder de detencion infinita sin derecho a juicio. Además, autorizó a la policía local reforzar las leyes migratorias. Pero el liberal Ted Kennedy la apoyo, y todos los demócratas en el comite del Senado judicial votaron por ella, y casi todos los integrantes del piso de Senadores votaron por ella.

Necesitamos un movimiento independiente que difunda la lucha de masas

Habiendo sido aceptada la viciosa propuesta antimigrante comprometida del Senado, solo se estaría esperando para que la propuesta 4377, incriminando inmigrantes, se convirtiera en ley. Por ahora esta ha fallado, el congreso se ha ido de vacaciones por dos semanas , y es incierto cuando el Senado pondrá en orden otra propuesta de ley antimigratoria. Baja el punto de vista de inmigrantes y la clase trabajadora, esto es lo mejor que pudo haber pasado.

El Congreso, es una institución donde los representantes políticos de los ricos arreglan las diferencias para convertirlas a ley, en servicio de la clase capitalista, y no de la clase trabajadora - la mayoria en este pais - mucho menos trabajadoras inmigrantes. Las fallas en el arreglo de estas diferencias, son las que nos permiten examinar de cerca todas las propuestas de la Legislación, y no cegarnos por lideres que nos harían tragar el veneno como el de la propuesta McCain-Kennedy, cuando en realidad significaría que los derechos de los inmigrantes serían denegados mas que antes. Nos permite , tambien dar una mirada de cerca a las preguntas teoricas revizadas por el Congreso e incluso por el Minutemen tales como que la immigration no es la causa del desempleo (paises con casi no imigratio como es Japón, presenta desempleo) sino que es el sistema capitalista que crea este desempleo y que por su simple naturaleza debe de crearlo. También, nos permite mas tiempo para crear organizaciones que no fomenten ilusiones de tener una mejor vida para los imigrantes, que sera garantizada por el Congreso, organizaciones que mueva masas dentro de una camino político independiente que lucha por sus propios intereses. En corto, que provea conditiones mas favorables para contruir un movimiento militante demandando ¡Derecho completo para todos los inmigrantes, ahora!

Attacks on Immigrants Are Attacks on the Working Class—

Full Rights for all Immigrants Now!

Millions of immigrants are taking to the streets in protest against the vicious legislation Congress has been rigging up against them. There are bills that would turn 10-12 million people in this country into felons overnight, bills that would lock millions of people into second class status for 12-13 years before they could get citizenship, bills for a “guest worker” program to super-exploit the 1.5 million Mexican, Caribbean and other workers in agriculture, bills that would subject immigrants to a police-state regime, and much more. Besides these bills, this great eruption of protest is also connected with the underlying anger that has for years been building against the racial discrimination and oppression that non-white immigrants are subjected to.

Driving the reactionary Congressional crusade is the fact that the capitalists want immigrant labor without rights so that they can more profitably exploit it. Laws that keep millions of immigrant workers living in fear of deportation if they strike or otherwise stand up for their rights serves this purpose, as do “guest worker” laws that deny these workers the same rights as other workers. In this way the profits of the capitalists are maximized while the living and working conditions of the working class as a whole are driven downward.

For the working class to effectively resist this situation it must demand full rights for its immigrant sisters and brothers whether they have papers or not. But, as the Congressional debates over these new anti-immigrant laws have shown, the demand for full immigrant rights is one that must be raised from the streets as part of the overall struggle between workers and capitalists.

The workers—native born, naturalized, or new immigrants—have no friends in Congress

Sensenbrenner’s H.R. 4437, the McCain-Kennedy bill, and the failed Senate compromise bill that was constructed around the McCain-Kennedy bill all are (or were) vicious attacks on immigrants, and thereby, all workers.

H.R. 4437, which passed the House in December, is the notorious bill that would turn the estimated 10-12 million “illegal” immigrants currently working, paying their bills, going to the store, etc., etc., in the U.S. into felons, as well as making it a felony for a citizen to assist them in any way. It would also fund construction of 700 more miles of wall along the U.S.-Mexico border, hire more immigration cops, and a long list of other police-state measures.

This is the bill that has stirred millions of people in this country into political motion during the past few months. From small towns to large cities they’ve gone into the streets to protest, with some of the demonstrations being the largest ever held in a particular city or area. In Chicago over 100,000 people filled the streets March 15, in Los Angeles 500,000 to a million people poured into the streets on March 25, and on April 9, 350,000-500,000 people marched in the streets of Dallas. There have also been bold walkouts by students, walkouts by workers and other protests largely centered in Mexican nationality communities.

These events have been a welcome breath of fresh air in the midst of the putrid right-wing stench that has been emanating from Washington for decades. But the dominant leadership of the big protests, the mainstream immigrant rights groups, and the class-collaborationist leaders of the SEIU, and UNITE-HERE unions have been working to channel the just hatred against the openly anti-immigrant H.R. 4437 into support for the McCain-Kennedy bill, and even the Senate compromise bill. This is betrayal of the masses because these are also rotten anti-immigrant bills.

The McCain-Kennedy bill would more than double the number of border patrol agents and increase coordination between different police departments. It would spend billions of dollars to install a high-tech electronic surveillance system along the U.S.-Mexico border (a “virtual” wall rather than Sensenbrenner’s real wall). Of course the U.S. government started building fences and escalating these kind of measures along the Mexican border under Clinton in 1994, and they haven’t stopped people from crossing illegally. All they’ve done is to drive people farther into the mountains and deserts to find a way across. And the April 6 Seattle Post-Intelligencer even quotes human smugglers boasting that they like these measures because they’ve been able to quadruple their “price” in 10 years, and they see more money in the offing with more walling-off. (The morticians have also gotten more business—460 men, women and children died while trying to cross in the wastelands just last year.)

But this is only the beginning. The McCain-Kennedy bill would set up an electronic verification system requiring immigrants to carry a new tamper-proof I.D. card connected to a huge national data base containing the immigrants’ work history, legal status, fingerprints, iris scan, etc. Further, the bill calls for eventually extending this electronic verification to all workers. This is a framework for establishing a fascistic national I.D. system that employers and the government can use to track all workers, spy on worker organizers and other activists, fire those they don’t like, etc.

So, after all this, how have the leaders of the big protests, union officials, “official” immigrant rights groups, etc., been able to get away with supporting this reactionary bill? Well, they’ve cried that a “comprehensive” reform was needed, and, ignoring the attacks the McCain-Kennedy contained, crowed that it would give undocumented workers legal status! But they’ve generally hidden such facts as that to there are giant hurdles that an immigrant must leap for at least 10 years before s/he can get citizenship, and all undocumented immigrants wouldn‘t be covered anyway. It would take six years just to get a green card! The hurdles include coming up with thousands of dollars in fines or fees, passing various tests, not being out of work for more than 60 days, etc. Thus, for more than a decade these immigrant toilers would have a second class status, be closely watched by the government, and have deportation hanging over their heads if they raised their voices in struggle against their conditions. Further, the hurdles in this bill are so high that it would be impossible for many undocumented people to make them, while others would not want to come forward to for years jump hurdles that they at some point might fail, and then be deported for failing.

The Senate compromise bill was even worse. It reduced the number of temporary legal immigrants by 75,000 per year from the McCain-Kennedy proposed 400,000 (and Yahoo‘s Daily News reported that it could now take as long as 13 to 14 years for some undocumented immigrants to gain citizenship). It provided for a new program for 1.5 million temporary agriculture industry workers over five years (semi-serf labor). And it allowed for more deportations of non-citizens without a hearing, expanded powers for indefinite detention without a trial, and authorized local police to enforce immigration laws. But the liberal Ted Kennedy supported it, all of the Democrats on Senate Judiciary Committee voted for it, and almost all voted for it on the Senate floor.

We need an independent movement that relies on mass struggle!

Had the viciously anti-immigrant Senate compromise bill passed, it would still have had to have been compromised with the House bill 4437 outright criminalizing immigrants in order to become law. But now that it has failed it’s unclear whether the Senate will be able to put together another anti-immigrant bill soon. From the standpoint of immigrants and the working class we think this is the best thing that could have happened. A good bill can only come as a by-product of intensified mass struggle.

Congress is an institution where the political representatives of the rich iron out differences and pass laws that serve the capitalist class, not the working-class majority of this country—much less immigrant workers. Its present failure to iron out differences allows us more time to look at the fine print in all the proposed legislation, and not be blind-sided by leaders who would have us swallow poison like McCain and Kennedy’s proposals that would in fact deny immigrants rights as never before. It allows more time to look into theoretical questions raised in Congress and even raised by the Minutemen…like why it is that immigration is not the cause of unemployment (i.e., countries with almost no immigration, like Japan, have unemployment), but that the capitalist system itself creates unemployment, and by its very nature must create it. It allows more time to build ongoing organizations that foster no illusions that a better life for immigrants is going to be granted by Congress, and which rally the masses onto the path of independent political struggle in their own interests. It provides more favorable conditions for building a movement militantly demanding full rights for all immigrants now!
