Softbelly's filed a motion to vacate the judgment on the grounds of witness tampering. U.S. District Judge Charles Norgle, who heard the case, denied the motion. The Seventh Circuit Court of Appeals subsequently ruled Norgle erred in his handling of the witness tampering issue and remanded the case to a new District Judge for further proceedings. An evidentiary hearing on the witness tampering issue was held before Judge Joan H. Lefkow, with Warner and Nizamian testifying to their recollection of Warner's phone call.

Judge Lefkow found that "[n]ot only did Warner telephone Nizamian to dissuade him from testifying, it follows that Warner also lied during the evidentiary hearing regarding the witness tampering issue, despite being under oath."
