FIRE FIGHTER VERDICT AFFIRMED AGAINST FEDERAL SIGNAL

(Chicago, IL) -- “Justice delayed, but not denied,” asserted Attorney Jordan Margolis of The Margolis Firm PC, www.themargolisfirm.com after an Illinois Appellate Court Affirmed the February 2009 Verdicts on behalf of 9 Chicago Fire Fighters against Federal Signal Corporation, (Fourth Division, September 13, 2012).

The Verdicts totaled $445,000 for permanent hearing loss caused by the Fire Fighters’ exposure to
unreasonably dangerous sirens. Margolis filed this Mass Tort Litigation in Cook County, Illinois over a decade ago, in 1999, beginning with 700 Chicago Fire Fighters, but which now includes Fire Fighters from over 16 States and almost 200 Fire Departments.

“Hopefully, the Appellate Court’s salient Opinion will speed the litigation process towards ultimate resolution by trials or settlement for the remaining 2300 Fire Fighter clients my firm so proudly represents,” adds Margolis who has practiced law for thirty-three years. “Most importantly, after over a decade of denials, Federal Signal should change the design of its sirens to focus the necessary warnings forward while reducing the harmful rearward noise to safe levels for our heroic First Responders.”

The Appellate Court cited Plaintiffs’ Expert, Dr. Donald Henderson, who testified that “Chicago Firefighters were routinely exposed to 109.8 dB, an exposure range about 556% of the permissible dose of acceptable noise exposure.”

When he learned about the Appellate Court Decision, Thomas E. Ryan, Jr., President of Local 2 (Chicago Fire Fighters Union) said; “We fight fires and respond to medical emergencies, which includes finding and pulling people to safety in smoke filled buildings. Fire Fighters rely on our hearing more than anybody. This Judicial Decision may save lives.”
