The FCC Enforcement Bureau has dismissed the complaints of Angela F. Woods that Homewood, Ala. radio personalities "Lex and Terry" used “offensive” language and wished her personal ill will while on the air.

Ms. Wood’s wrote to the bureau, which has the mission of “fostering efficient use of the spectrum while furthering public safety” to report that after hearing the “foul” and “obscene” word “pussy” broadcast during the morning show she had called the station to complain and was then verbally attacked by Mr. Staley (Lex) and Mr. Jaymes (Terry) on the air.

Ms. Woods reported that Mr. Staley and Jaymes referred to her as a "bitch" that needed a "stick up her ass."

After arriving at work, Ms. Woods and her coworkers were listening to the same station and heard the on-air personalities say they "hope she has a wreck and gets killed on the way to work."

The Bureau dismissed the complaint noting the series of remarks were "certainly offensive, but are not indecent because they are not patently offensive as measured by contemporary community standards for the broadcast medium.”

Writing in response to the bureau’s “dismissal without even attempting to ascertain from the broadcaster whether the elements of an indecent broadcast were present,” FCC Commissioners Gloria Tristani said, “I cannot sit mute while legitimate citizen concerns are dismissed with vulgar and profane attacks. Permitting its employees to exploit the invasive nature of the broadcast medium to stalk or shadow its listeners in this manner is misconduct, if not actionable misconduct.”

Commissioners Tristani goes on to cite an Alabama law that has established the misdemeanor crime of "Harassing Communications," which occurs when one “communicates with a person, anonymously or otherwise, by telephone, telegraph, mail, or any other form of written or electronic communication, in a manner likely to harass or cause alarm.”

“It cannot be overlooked that the broadcaster's alleged over-the-air attack on Ms. Woods was deliberate, calculated to offend and did in fact cause alarm,” Commissioners Tristani wrote. “Unfortunately, this Commission has erected so many barriers to complaints from the public that our indecency enforcement program is rendered ineffective,” the commissioner writes.

The “Lex and Terry” show broadcasts from 6 A.M. until 10 A.M. and has been #1 in it’s market since 1997. “It's just about two average guys, living your lifestyle. It is about relationship advice…and of course ‘boys just being boys,’” the “Lex and Terry” web site states.

Some of the shows latest guests include Exotica who dropped by and allow the “boys” to rub their faces in her breasts and porn stars Ginger Lynn and Jenteal. “Lex and Terry” are proud sponsors of the “Ms. Nude 2000 Contest” and Valentines Day will the Vibrating Panties show.

Among the features on the “Lex and Terry” website are the “Ultimate L& T Babe,” which includes Playmate Cori Nadine and Penthouse Pet Heather Kelly, the “Who will be the first L&T Fan to Die 2001?” and the “Biggest Ho” contests and the “Top 10 Adult Videos.”

The WRLR radio station itself supports the “Breast Fest,” employee’s “Prize Babe” to distribute contest prizes, and refers to a male member of their staff as the “Bitch” because he does “all the crap that no one else wants to.”
