October 22nd National Day Of Protest Will Go On

The October 22nd Coalition’s lawsuit seeking a TRO to reinstate a previously granted rally permit in Federal Plaza was denied by Judge Holderman in federal district court on Thursday. A hearing on the preliminary injunction to overturn the Federal Plaza permit ban is set for Thursday, October 25th. The events in court justified the widespread alarm felt by civil liberties advocates that the Federal Plaza permit ban represents a dangerous precedent in restricting civil liberties.

Plaintiffs’ attorney Wayne Giampietro argued in court that the Government cannot just wave a “magic wand” to overturn legal precedent and forbid free statement in a public space. US Attorneys argued they can, and will, do exactly that. What became clear in court is that the US Government has every intention of using the Sept. 11th tragedies to provide a blank check for curtailing free speech. No compelling reasons were given why the exercise of free statement on October 22nd at Federal Plaza would harm security. Instead, US Attorneys resorted to patently false statements to justify why the National Day of Protest to Stop Police Brutality would represent a security concern while seven other demonstrations held since September 11th did not. They told Judge Holderman that previous demonstrations had only 25 people, when in fact three of those rallies had several hundred people and one was reported in the media to have 1000.

The October 22nd Coalition is going forward with plans to gather for a peaceful kickoff rally at Federal Plaza before marching to a final rally site at the State of Illinois Building where a rally permit has been obtained. No interference is anticipated while gathering at Federal Plaza which would be consistent with the experience of the seven previous rallies held without a permit since September 11. If prevented from gathering at Federal Plaza, participants will gather at an adjacent space before marching to the State of Illinois Building. Matt Rothwell, October 22nd Coalition spokesperson, stated: “Faced with police brutality and the unjust incarceration of their children, there are many in this society who already feel they have no rights. In the face of this, we can’t just turn our backs as existing civil liberties are taken away piece by piece.”
